Terms & Conditions

Last Updated: September 15, 2026

Think Different Dementia, LLC, doing business as DigniCare™ by Design (“DigniCare™ by Design,” “we,” “us,” or “our”), provides Caregiving System Advising and related educational content, events, and services.

These Terms & Conditions (“Terms”) govern your use of the DigniCare™ by Design public website, registration pages, public content, events, workshops, Ask the DigniCare™ Advisor, Fit Calls, and other services expressly made subject to these Terms.

Certain DigniCare™ by Design services, including Direct Access Caregiver Advising, are governed by a separate written agreement. Where a separate written agreement applies, that agreement governs that service and controls in the event of a conflict with these Terms.

By registering for or using a service governed by these Terms, you agree to these Terms. If you do not agree with these Terms, please do not register for or use that service.

1. DigniCare™ by Design and Caregiving System Advising

DigniCare™ by Design provides Caregiving System Advising for the caregiver everyone depends on.

Caregiving System Advising interprets, organizes, reorganizes, and orders the caregiving system over time as dependency and circumstances change.

The caregiving system includes the interrelated people and familial households involved in care and the dependency, relationships, roles, responsibilities, authority, environments, resources, preferences, beliefs, and limits that affect how the caregiving situation actually works. The caregiving system may also be affected by information, recommendations, requirements, restrictions, resources, services, or consequences introduced by healthcare, legal, financial, insurance, church, employment, government, and other outside systems.

Caregiving System Advising helps the caregiver everyone depends on understand what is actually happening, distinguish what belongs where, recognize what has changed, and determine what’s next within the responsibility, authority, resources, relationships, and limits actually present.

DigniCare™ by Design may also provide educational content, workshops, public events, podcast content, Fit Calls, and other resources through which caregivers can learn about caregiving situations and Caregiving System Advising.

2. Scope and Limits of Caregiving System Advising

Caregiving System Advising is an advisory service. It may include interpreting an actual caregiving situation, identifying what requires attention, distinguishing and constraining relevant variables, considering realistic options, making recommendations when the available information supports them, and ordering what needs attention next.

Caregiving System Advising does not replace the responsibilities, expertise, or authority of physicians, therapists, attorneys, financial professionals, pastors, facilities, home-care agencies, insurers, government programs, or other professionals, organizations, or systems involved in a caregiving situation.

DigniCare™ by Design does not provide medical diagnosis or treatment, therapy or counseling, legal advice, financial advice, or pastoral care through Caregiving System Advising.

Information, requirements, determinations, or recommendations that properly belong to another professional or system should be obtained from an appropriately qualified person or organization.

Caregiving System Advising may help a caregiver understand how that information, requirement, determination, or recommendation affects the caregiving system without replacing the professional or system from which it arises.

DigniCare™ by Design does not provide emergency or crisis services. If you believe you or another person is experiencing an emergency, contact the appropriate emergency service or qualified professional.

3. Public Educational and Advising Services

DigniCare™ by Design may provide public educational and advising services designed to help caregivers understand caregiving situations and become familiar with the work of Caregiving System Advising.

These may include educational workshops, Ask the DigniCare™ Advisor, podcast and website content, and other public resources.

Educational content and workshops may explain or demonstrate concepts relevant to Caregiving System Advising but do not, by themselves, create an individual Caregiving System Advising relationship.

Ask the DigniCare™ Advisor

Ask the DigniCare™ Advisor is a live educational and advising event in which participants may bring caregiving situations for discussion.

Advising provided during Ask the DigniCare™ Advisor is based on the information available during that event. Participation does not establish the ongoing advisory relationship or continuity of context provided through Direct Access Caregiver Advising.

Ask the DigniCare™ Advisor is recorded. Registration requires the applicable recording and use consent. Additional terms concerning recording, transcription, privacy, and possible publication appear below and in our Privacy Policy.

Educational Workshops

DigniCare™ by Design may offer educational workshops concerning caregiving situations, Caregiving System Advising, and related category concepts.

Workshops are educational rather than individualized advisory engagements. Participation in a workshop does not create a Direct Access Caregiver Advising relationship.

Workshop topics, format, availability, and registration requirements may change over time.

4. Fit Calls and Direct Access Caregiver Advising

A Fit Call is used to determine whether Direct Access Caregiver Advising is appropriate for an actual caregiving situation.

The Fit Call may clarify enough of the situation to determine whether Caregiving System Advising appears to be the work needed and whether Direct Access Caregiver Advising is an appropriate fit. A Fit Call is not a free advisory session and does not create a Direct Access Caregiver Advising relationship.

If DigniCare™ by Design and the prospective client agree to proceed, the Direct Access Caregiver Advising relationship begins only as provided in the applicable separate agreement.

Direct Access Caregiver Advising is the product and access model through which DigniCare™ by Design provides Caregiving System Advising through an ongoing advisory relationship with continuity of the caregiving situation, system, and relevant history.

Direct Access Caregiver Advising is governed by its own agreement, including the terms applicable to the advisory relationship, access, fees, cancellation, confidentiality, recording or transcription, use of technology, and other matters specific to that service.

5. Registration and Communications

Certain DigniCare™ by Design events and services require registration.

When registering, you agree to provide information that is accurate and reasonably current and to provide contact information that allows us to communicate with you concerning the event or service you requested.

We may use your registration information to send confirmations, access information, scheduling information, reminders, changes or cancellations, and other communications reasonably related to your registration or requested service.

We may also send marketing emails where permitted. Marketing emails will include an appropriate method to unsubscribe. Unsubscribing from marketing communications does not prevent us from sending communications necessary to administer a registration, transaction, or existing service relationship.

Where offered, you may separately choose to receive non-marketing text messages concerning registrations, reminders, scheduling, access information, changes, or similar service-related communications.

Message frequency may vary. Message and data rates may apply. You may opt out of text messages by replying STOP. For assistance, reply HELP or contact us using the information provided in these Terms.

We do not sell mobile information or SMS consent information to other businesses for their marketing purposes.

6. Confidentiality

DigniCare™ by Design treats information shared within an individual Caregiving System Advising relationship as confidential, subject to the applicable service agreement, these Terms, our Privacy Policy, the use of service providers and technologies described below, and disclosure when required or permitted by law.

Confidentiality does not mean that information is processed only personally by the advisor or stored only on a single device. We use technology and third-party service providers in operating DigniCare™ by Design, including services used for communications, videoconferencing, recording, transcription, artificial intelligence, information processing, storage, and business administration.

Information may be processed by those providers as reasonably necessary to provide and operate the applicable service.

Public or group events are different from an individual advisory relationship. Information voluntarily shared during a workshop, Ask the DigniCare™ Advisor, or another group setting may be heard by other participants and should not be treated as confidential merely because the event is provided by DigniCare™ by Design.

Our Privacy Policy provides additional information about how personal information is collected, processed, disclosed, retained, and protected.

7. Recording and Transcription

DigniCare™ by Design uses recording and transcription as a regular part of its operations. Meetings, calls, advising sessions, Fit Calls, events, and other interactions may be recorded and transcribed, subject to applicable notice and consent requirements.

Recordings and transcripts may be used to maintain an accurate record of the interaction; preserve relevant context and history; prepare notes, summaries, follow-up, or other materials; support continuity of advising; retrieve and organize information; review prior discussions; conduct administrative work; and support the operation and development of DigniCare™ by Design.

Recording and transcription may be performed using third-party technology providers. Recordings, transcripts, summaries, notes, and related information may therefore be processed by those providers as described in our Privacy Policy.

Where applicable law or the nature of a particular service requires consent to recording, the applicable consent will be obtained. If recording is required as a condition of participating in a particular event or service, that requirement will be disclosed before participation.

Ask the DigniCare™ Advisor is a recorded event. Participation requires the applicable recording and use consent.

8. Artificial Intelligence and Information-Processing Technologies

DigniCare™ by Design uses artificial intelligence and other information-processing technologies as part of its business operations.

These technologies may be used to work with recordings, transcripts, notes, communications, documents, and other information for purposes such as transcription, summarization, organization, retrieval, analysis, drafting, preparation, recordkeeping, content development, and administrative support.

Information processed through these technologies may include information voluntarily provided during a caregiving conversation or advisory relationship. Third-party technology providers may process that information on our behalf according to their applicable terms, privacy practices, settings, and contractual arrangements.

Artificial intelligence and other technology may assist DigniCare™ by Design in processing and working with information. They do not provide Caregiving System Advising, replace the advisor’s judgment, assume responsibility for recommendations, or make caregiving decisions on behalf of the caregiver.

Our Privacy Policy provides additional information concerning the types of information we process, the purposes for which we process it, and the third-party services that may be involved.

9. Recording for Publication and Public Content

Recording or transcription for operational or advisory purposes does not by itself authorize public use or publication of a participant’s identifiable recording, voice, image, likeness, statements, or other material.

Some events, including Ask the DigniCare™ Advisor, are specifically recorded with the possibility that recordings or portions of recordings will be used in public DigniCare™ by Design content.

Where public use is contemplated, the applicable recording and use disclosure or consent governs that use.

Subject to the permission provided, a recording or portion of a recording may be edited, excerpted, reproduced, published, distributed, or incorporated into podcasts, educational materials, website content, social media, promotional materials, or other DigniCare™ by Design content.

Participants in recorded group events should not disclose names, identifying information, or other details they are not comfortable discussing in that setting or potentially having included in authorized published content.

10. Responsibility for Decisions and Recommendations

Caregiving System Advising may include a clear recommendation when the available evidence supports one.

Recommendations are based on the information available and the actual circumstances known at the time. DigniCare™ by Design does not guarantee that all relevant facts will be known or that circumstances will remain unchanged.

The caregiver retains responsibility for the decisions and actions that are actually theirs.

DigniCare™ by Design does not assume responsibility or authority belonging to the caregiver, another family member, the person receiving care, a professional, an organization, or another system. We cannot create authority that does not exist, require another person to cooperate, or control decisions or outcomes outside our authority.

11. No Guarantee of Outcomes

DigniCare™ by Design does not guarantee a particular outcome from Caregiving System Advising, educational content, workshops, Ask the DigniCare™ Advisor, Fit Calls, or other services.

Caregiving System Advising cannot guarantee agreement among family members, cooperation from another person, disease stability, service availability, financial resources that do not exist, authority a caregiver does not have, a risk-free choice, or a particular medical or functional outcome.

Individual circumstances and caregiving situations change. No recommendation, educational resource, or advisory service eliminates all uncertainty or risk.

12. Information You Provide

You are responsible for the information you choose to provide through our website, forms, registrations, events, Fit Calls, advising services, communications, or other interactions with DigniCare™ by Design.

Caregiving discussions may involve personal, family, health, financial, legal, or other sensitive information concerning you or another person. Please provide only information reasonably relevant to the purpose for which it is requested or discussed and use appropriate discretion when providing identifying or sensitive information.

When providing information about another person, you are responsible for exercising appropriate discretion concerning information you are authorized or otherwise permitted to share.

Information you provide may be recorded, transcribed, stored, organized, analyzed, summarized, or otherwise processed as described in these Terms and our Privacy Policy.

13. User Conduct

You agree to use the DigniCare™ by Design website, events, workshops, communications, and other services governed by these Terms lawfully and respectfully.

You may not use them to engage in unlawful activity; interfere with website or system security; attempt unauthorized access; impersonate another person; transmit malicious code; disrupt an event; harass or threaten another participant; record, reproduce, or redistribute an event or DigniCare™ by Design material when not authorized to do so; or violate the rights of DigniCare™ by Design or another person.

We may restrict or terminate access to the website, events, workshops, or other services governed by these Terms when reasonably necessary to protect DigniCare™ by Design, participants, our systems, or others.

14. Intellectual Property

Unless otherwise stated, the DigniCare™ by Design website, branding, frameworks, methods, written materials, graphics, videos, audio recordings, podcasts, workshops, educational materials, and other content provided by us are owned by or licensed to Think Different Dementia, LLC.

This includes DigniCare™ by Design’s original Caregiving System Advising materials and methods.

You may access and use publicly available DigniCare™ by Design content for your personal, non-commercial use unless we provide written permission for another use.

You may not reproduce, republish, distribute, modify, sell, license, commercially exploit, teach as your own, or create derivative commercial materials from our proprietary content without prior written permission, except as permitted by applicable law.

Nothing in these Terms transfers ownership of information or original materials that you provide to DigniCare™ by Design.

15. Feedback and Testimonials

If you voluntarily provide comments, feedback, reviews, or testimonials to DigniCare™ by Design, we may use them for the purpose for which they were submitted and as otherwise authorized by you.

Providing feedback or a testimonial does not by itself authorize public disclosure of confidential or sensitive information from an advisory relationship.

Where identifiable client information, recordings, statements, images, or other materials require additional permission for public use, the applicable permission or consent governs that use.

16. Third-Party Services

DigniCare™ by Design uses third-party services and technologies to operate its business.

These may include providers used for website hosting, registration, customer relationship management, email, text messaging, videoconferencing, recording, transcription, artificial intelligence and information processing, scheduling, analytics, advertising measurement, payment processing, storage, security, podcast distribution, and administrative or technical functions.

Third-party providers process information according to their own applicable terms, privacy practices, settings, and contractual arrangements.

We are not responsible for the independent content, availability, security, privacy practices, or operation of third-party websites or services that we do not control.

Additional information about third-party processing of personal information appears in our Privacy Policy.

17. Website, Event, and Service Availability

We make reasonable efforts to maintain the DigniCare™ by Design website and provide scheduled public services, but we do not guarantee uninterrupted or error-free availability.

We may modify, reschedule, suspend, cancel, discontinue, or replace website content, workshops, events, or other services governed by these Terms when reasonably necessary.

The availability, schedule, format, subject matter, or frequency of public content, Ask the DigniCare™ Advisor, workshops, Fit Calls, and other public services may change over time.

18. Disclaimer of Warranties

To the extent permitted by applicable law, the website, public content, educational materials, workshops, events, and other services governed by these Terms are provided on an “as is” and “as available” basis.

We do not warrant uninterrupted availability, freedom from error, or that information or services will be appropriate for every person’s particular circumstances.

Nothing in these Terms excludes warranties, rights, or protections that cannot legally be excluded.

19. Limitation of Liability

To the maximum extent permitted by applicable law, Think Different Dementia, LLC, DigniCare™ by Design, and their owners, employees, contractors, agents, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to the website or services governed by these Terms.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

20. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Think Different Dementia, LLC, DigniCare™ by Design, and their owners, employees, contractors, and agents from claims, liabilities, damages, losses, and reasonable expenses arising from your unlawful use of the website or services governed by these Terms, your material violation of these Terms, or your violation of the rights of another person.

21. Privacy and Cookies

Our Privacy Policy describes how we collect, use, process, disclose, retain, and protect personal information, including information associated with recordings, transcripts, communications, and the use of artificial intelligence and other third-party technologies.

Our Cookie Policy describes our use of cookies and similar technologies on the DigniCare™ by Design website and the choices available concerning those technologies.

The Privacy Policy and Cookie Policy should be read together with these Terms where applicable.

22. Changes to These Terms

We may update these Terms as our website, services, business practices, technology, or legal obligations change.

When we make changes, we will update the Last Updated date at the top of these Terms. We will provide additional notice of material changes when required by applicable law.

Your continued use of services governed by the revised Terms after they become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

Changes to a service governed by a separate written agreement remain subject to the terms of that agreement.

23. Governing Law

These Terms are governed by the laws of the State of South Carolina, without regard to its conflict-of-law principles, except where applicable law requires otherwise.

24. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

25. Relationship to Separate Agreements

These Terms govern the website and the events, content, and services expressly made subject to them.

Certain DigniCare™ by Design services are governed by separate written agreements.

In particular, Direct Access Caregiver Advising is governed by the applicable Direct Access Caregiver Advising agreement. If a provision of these Terms conflicts with a provision of a separate written agreement governing a particular service, the separate written agreement controls with respect to that service.

Nothing in these Terms modifies the terms of a separate written agreement unless that agreement expressly provides otherwise.
