This Privacy Policy explains how we collect, use, process, disclose, retain, and protect personal information when you interact with DigniCare™ by Design, including through our website, communications, registrations, events, and services.
Our Terms & Conditions govern use of our public website and applicable public services. Certain services may also be governed by a separate written agreement.
1. Information We Collect
The information we collect depends on how you interact with DigniCare™ by Design.
Information You Provide
We may collect information you provide directly to us, including your name, email address, telephone number, mailing address, time zone, registration information, form responses, communications, and other information you choose to provide.
When you participate in situation-specific advising or related services, information you provide may concern you, the person receiving care, family members, other people involved in care, and professionals, organizations, or systems affecting the caregiving situation. Depending on the circumstances, this may include personal or sensitive information concerning relationships, living circumstances, caregiving roles and responsibilities, authority, functional abilities, health conditions or diagnoses, medications, services, resources, finances affecting the caregiving situation, legal or planning arrangements, beliefs or preferences, and other information relevant to the service.
Please provide only information reasonably relevant to the purpose for which it is requested or discussed and use appropriate discretion when providing identifying or sensitive information about another person.
Communications, Recordings, Transcripts, and Notes
We may collect and maintain communications between you and DigniCare™ by Design, including email, text messages, forms, documents, and other correspondence.
Because recording and transcription are regular parts of our operations, we may also collect or create audio or video recordings, transcripts, summaries, notes, extracts, action items, and other information derived from interactions with DigniCare™ by Design.
These materials may contain personal or sensitive information depending on what is discussed.
Information Collected Automatically
When you use our website, we and our service providers may automatically collect technical and usage information such as IP address, browser and device information, operating system, pages viewed, website interactions, referring pages, approximate location derived from IP address, dates and times of visits, and information collected through cookies and similar technologies.
Our Cookie Policy provides more information about cookies, analytics, advertising technologies, and your cookie choices.
Transaction Information
When a payment is made, payment information may be processed by a third-party payment provider. We may receive information necessary to administer the transaction, such as the amount, date, payment status, or transaction identifier. We do not need to receive or store complete payment-card information when it is processed directly by the payment provider.
2. How We Use Information
We may use personal information to:
- provide, administer, and support requested services;
- communicate with you and respond to inquiries;
- manage registrations, scheduling, reminders, and service-related communications;
- maintain records and continuity of relevant information;
- review, organize, retrieve, summarize, and work with information provided to us;
- prepare notes, follow-up, communications, and other materials;
- operate, maintain, secure, and improve our website and business operations;
- develop and manage DigniCare™ by Design content and services;
- process transactions and maintain business records;
- measure website use and performance;
- measure the effectiveness of marketing activities where applicable;
- protect our rights, systems, users, and services; and
- comply with applicable legal obligations.
We may use information for another purpose when you direct us to do so, provide appropriate permission, or when otherwise permitted by law.
3. Recording and Transcription Data
Recordings and transcripts may be used to preserve an accurate record of an interaction, maintain relevant context and history, prepare notes or follow-up, support continuity, retrieve and organize information, review prior discussions, and perform administrative or business functions.
Recordings and transcripts may be processed through third-party recording, transcription, storage, artificial intelligence, or other information-processing services used by DigniCare™ by Design.
The Terms & Conditions and, where applicable, a separate service agreement address the conditions under which interactions are recorded and any permissions applicable to participation or use. This Privacy Policy addresses how the resulting information is handled.
4. Artificial Intelligence and Information Processing
DigniCare™ by Design uses artificial intelligence and other information-processing technologies as part of its operations.
These technologies may process recordings, transcripts, notes, communications, documents, and other information for purposes such as transcription, summarization, organization, retrieval, analysis, drafting, preparation, recordkeeping, content development, and administrative support.
Information submitted to or processed through these technologies may therefore be processed by third-party technology providers acting in connection with the services they provide to us.
Artificial intelligence assists with information processing and related work. DigniCare™ by Design remains responsible for its own advising judgment and does not rely on artificial intelligence to assume responsibility for caregiving decisions.
We do not represent that information processed by third-party artificial intelligence providers is subject to healthcare privacy laws or protections that do not otherwise apply to DigniCare™ by Design or the applicable provider.
5. How We Disclose Information
We do not sell your personal information.
We may disclose personal information when reasonably necessary to service providers that help us operate DigniCare™ by Design. These may include providers used for:
- website hosting and technical services;
- email and communications;
- registration and customer relationship management;
- scheduling;
- videoconferencing;
- recording and transcription;
- artificial intelligence and information processing;
- document and data storage;
- payment processing;
- analytics and website measurement;
- advertising measurement;
- security; and
- other administrative or business functions.
These providers may process information on our behalf or as otherwise described in their applicable terms, privacy practices, settings, and contractual arrangements.
We may also disclose information when reasonably necessary to comply with applicable law, legal process, court order, or lawful government request; protect our rights or property; investigate fraud, misuse, or security concerns; protect the rights or safety of another person; or establish, exercise, or defend legal claims.
If Think Different Dementia, LLC is involved in a merger, acquisition, financing, reorganization, sale of assets, or similar business transaction, information may be disclosed as reasonably necessary in connection with that transaction, subject to applicable law.
We may disclose information for another purpose with your direction or permission.
6. Confidentiality and Service Providers
DigniCare™ by Design treats information shared within an individual advisory relationship as confidential, subject to the applicable service agreement, necessary processing by service providers, and disclosures permitted or required by law.
Confidentiality does not mean that information is never processed by technology or third-party providers. Providers used for recording, transcription, artificial intelligence, communications, storage, and other operational functions may process information as reasonably necessary to provide those services.
Information voluntarily shared in a public or group setting may be heard or observed by other participants. The Terms & Conditions govern participation in those settings.
Our commitment to confidentiality is not a representation that DigniCare™ by Design is a HIPAA-covered healthcare practice or that information is protected by physician-patient, therapist-client, attorney-client, or other professional privilege where such protection does not otherwise apply.
7. Recordings and Public Use
Creating a recording or transcript for operational or advisory purposes does not by itself authorize public use of identifiable material.
Certain events or interactions may involve separate permission for recordings, excerpts, voice, image, likeness, statements, or other identifiable material to be edited, reproduced, published, distributed, or incorporated into DigniCare™ by Design content.
Where such public use is contemplated, the applicable disclosure, permission, or consent governs that use.
The Terms & Conditions provide additional information concerning recorded public events and publication.
8. Email and Text Communications
We may use your email address to provide information you requested, registration confirmations, scheduling information, reminders, service communications, responses to inquiries, and other communications related to your relationship with DigniCare™ by Design.
If you receive marketing emails from us, you may unsubscribe using the unsubscribe method provided in those messages. Unsubscribing from marketing email does not prevent us from sending communications reasonably necessary to administer a registration, transaction, or existing service relationship.
Where text messaging is offered, providing a mobile number and agreeing to receive text messages are separate choices where applicable. Text messages may include registration, scheduling, reminder, access, or other service-related communications.
Message frequency may vary. Message and data rates may apply. You may reply STOP to opt out of text messages or HELP for assistance.
We do not sell mobile information or SMS consent information to third parties for their marketing purposes.
9. Website Analytics and Advertising Technologies
We use technologies that help us understand how visitors use our website, measure website performance, and evaluate the effectiveness of marketing activities.
These may include Google Analytics, Google Tag Manager, Microsoft Clarity, and the Meta Pixel.
Depending on the technology and your cookie choices, these services may process information about your device, browser, IP address, website activity, interactions, referring source, and similar technical or usage information.
We do not intentionally send medical conditions, diagnoses, health information, private caregiving details, or other sensitive information submitted by an individual to Meta through our advertising or analytics event parameters.
Our Cookie Policy explains the categories of cookies and similar technologies used on our website and the choices available to you.
10. Cookies and Similar Technologies
Our website uses cookies and similar technologies for purposes that may include website functionality, preferences, analytics, and advertising measurement.
Because cookies and similar browser technologies have their own data collection and choice mechanisms, the details of those technologies are provided in our separate Cookie Policy rather than repeated here.
11. Data Retention
We retain personal information for as long as reasonably necessary for the purposes for which it was collected or created, including providing and maintaining services, preserving relevant business and advising records, maintaining continuity where applicable, resolving disputes, enforcing agreements, and meeting legal, accounting, or other legitimate business requirements.
Different types of information may be retained for different periods depending on their purpose, the nature of the relationship, applicable agreements, technical systems, and legal or business requirements.
Recordings, transcripts, notes, communications, and other service-related records may therefore be retained as part of DigniCare™ by Design’s business or advisory records where reasonably necessary for those purposes.
When information is no longer reasonably necessary, we may delete, anonymize, or otherwise dispose of it, subject to applicable legal, technical, archival, backup, and recordkeeping requirements.
12. Information Security
We use reasonable administrative, technical, and organizational measures intended to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure.
No website, electronic communication, storage system, recording system, artificial intelligence service, or method of transmitting information over the internet can be guaranteed to be completely secure.
You should use appropriate discretion when communicating sensitive information electronically or discussing information concerning another person.
13. Your Privacy Choices and Requests
Depending on the circumstances and applicable law, you may contact us to ask about personal information we maintain about you or request that we correct or delete information.
Certain information may need to be retained when reasonably necessary to provide a service, maintain legitimate business records, comply with an agreement or legal obligation, resolve a dispute, protect legal rights, or for another purpose permitted by law.
Requests concerning cookie and similar technology preferences are addressed through the choices described in our Cookie Policy.
Marketing email and text-message choices are addressed in Section 8 above.
To make a privacy request, contact us using the information at the end of this Policy. We may need to take reasonable steps to verify the request before acting on it.
14. Information About Other People
Caregiving conversations often involve information about people other than the person communicating directly with DigniCare™ by Design.
If you provide information concerning another person, please use appropriate discretion and provide only information reasonably relevant to the purpose for which it is being shared.
We may process information about another person when it is provided to us as part of a caregiving situation, communication, recording, transcript, document, or other interaction, subject to this Policy and applicable law.
15. Children’s Privacy
DigniCare™ by Design services are directed to adults and are not intended for children to use independently.
We do not knowingly solicit personal information directly from children through our website for the purpose of establishing an advisory relationship with them.
Information about a child may nevertheless arise when an adult provides information relevant to a caregiving situation. Such information is handled in accordance with this Policy.
16. Third-Party Websites and Services
Our website, communications, or services may contain links to or interact with websites, platforms, or services operated by third parties.
Those third parties may collect or process information under their own privacy policies and practices. This Privacy Policy does not govern the independent privacy practices of third parties that DigniCare™ by Design does not control.
17. Changes to This Privacy Policy
We may update this Privacy Policy as our website, services, technology, business practices, or legal obligations change.
When we update this Policy, we will revise the Last Updated date above. We will provide additional notice of material changes when required by applicable law.
